Mr. Debasis Kar Mr. Husen Mustafi ....for the Petitioner Mr. Kanak Kiran Bandyopadhyay ....for the WBSEDCL The grievance of the petitioner is directed against inaction of the respondent WBSEDCL from removing a transformer which is close to the boundary wall of the petitioner.

On behalf of the petitioner, it is submitted that notwithstanding having filed a representation as far back as in the year of 2023, the Officer-inCharge has taken no steps in the matter. It is also submitted on behalf of the petitioner that the said transformer is causing inconvenience and nuisance with the egress and ingress of the petitioner. On behalf of the WBSEDCL, it is submitted that the entire grievance of the petitioner is misplaced since the transformer is far away to the boundary wall of the petitioner.

In view of the submissions made on behalf of the parties, WPA 25820 of 2023 stands disposed of

by granting liberty to the petitioner to make a representation to the District Magistrate having jurisdiction within a period of seven days from date. If such representation is made within the above time period the District Magistrate is directed to consider the same after giving all the parties including WBSEDCL a right of hearing and disposing the representation within a period of eight weeks from the date of receipt thereof.

It is made clear that there has been no adjudication on the merits of the case and all questions are left open for the District Magistrate to decide in accordance with law.
