Matter is heard in presence of the learned advocates representing the petitioner and Union of India. 3.

At the threshold, Mr. Asok Kumar Chakraborty, learned Additional Solicitor General has raised the question whether writ petition is maintainable before this Court or not since as per relevant provisions of Administrative Tribunal Act, 1985, challenging the order dated 7th September, 2022 of Scientist-E (Legal Cell) petitioner needs to approach Central Administrative Tribunal.

Since in terms of Section 14 of the Administrative Tribunal Act, 1985 petitioner needs to approach

Central Administrative Tribunal, writ petition at this stage is not maintainable before this Court.

Writ petition stands dismissed.

However, this order shall not preclude the petitioner to approach Central Administrative Tribunal on selfsame cause of action. 7.
