Shah ... for the respondent Nos.2/West Bengal Staff Selection Commission The learned advocate representing the petitioner has filed an affidavit with regard to the maintainability of the instant writ petition, inter alia, stating that the petitioner had applied for the post of Pharmacist Grade-III which pertains to a civil post beyond jurisdiction of this Court to entertain at the very inception.

The learned advocate representing the petitioner conceded to the same.

The induction in the service through the procedure followed by the West Bengal Staff Section Commission for the post of Pharmacist Grade-III pertains to a civil post. Therefore, the instant writ petition is to be transferred to the appropriate Bench of the West Bengal Administrative Tribunal for disposal.

Necessary steps to be taken for such transfer accordingly.

With the above observation, the instant writ petition and connected applications are disposed of. It is recorded that this Court has not gone into the merits of the case.

The interim order granted by the coordinate Bench of this Court to continue until further orders.
