Md.Zeeshan v. State Of West Bengal
D/L 25 29.01.2026 Bpg.
Dismissed C.R.M. (M) 2454 of 2025 In Re: An application under Section 439 of the Code of Criminal Procedure 1973 for grant of Bail; read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Maidan Police Station Case No.38 of 2018 dated 26.04.2018 under Sections 392/397 of the Indian Penal Code, 1860;
Md. Zeeshan
Versus
The State of West Bengal Ms. Minoti Gomes Mr. Benajir Hasna Mr. Aliul Islam Mr. Sadid Haider.
...for the petitioner.
Mr. Partha Pratim Das Ms. Debolina Das.
...for the State.
Learned advocate appearing for the petitioner submits that the petitioner was initially granted interim bail but because of miscommunication he was not available before the court and warrant of arrest was issued in the year 2020 against the petitioner. Petitioner has been arrested on the basis of the execution of the process of law and produced before the learned trial court in the month of June, 2025 and since then he is in custody. Learned advocate for the petitioner prays for bail on any stringent conditions.
Learned advocate for the State opposes the prayer for bail and submits that the trial in this case was split up and similarly placed accused person has already been convicted by the learned
trial court. Presently, 9 witnesses have already been examined out of the proposed 16 witnesses which the prosecution intends to rely upon.
Having considered the materials appearing from the case records and the conduct of the present petitioner, I am not inclined to release the petitioner on bail.
Accordingly, CRM(M) 2454 of 2025 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
