1. Petitioner is in custody for about 120 days. There is no material to show that he abetted the commission of suicide. He prays for bail.

2. Learned lawyer for the State submits petitioner and the victim were staying in a hotel room. They quarreled. Subsequently, victim committed suicide.

3. We have considered the materials on record. Statements of witnesses show petitioner and the victim had quarreled before the incident. Mere quarreling may not constitute abetment to suicide. It is possible that the victim may have acted impulsively in a fit of rage. Investigation is complete. There is no chance of abscondence.

4. Under such circumstances, we are of the opinion petitioner has made out a case for bail.

5. Accordingly, we direct the petitioner namely, Sanjit Sur, shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Kalyani subject to condition that the petitioner shall appear before the trial court on each and every date of hearing until further orders and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.

6. In the event, petitioner fails to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel his bail prayer in accordance with law without further reference to this Court. Signed By :
