1. Learned counsel appearing for the petitioner submits as follows. A co-accused was granted anticipatory bail by this Court on 4.11.2025 in CRM (A) 3296 of 2025. The petitioner stands on a similar footing. The petitioner has been falsely implicated in this case.

2. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He refers to the materials available in the case diary including the statements of the victim and other witnesses and to the injury report which shows among other things, scalp edema. The injury report shows several injuries inflicted all over the body including the vital parts of the body like head and nose. The CT scan report corroborates the same showing scalp edema.

3. It was recorded in the earlier order granting anticipatory bail to a co-accused that from the statement of the victim,

it appeared that one Riju Dey i.e., the present petitioner had given the fatal blow. It was also recorded therein that the anticipatory bail was being granted considering the alleged role ascribed to the said petitioner.

4. Clearly, the present petitioner is not standing on the same footing as the one who was granted anticipatory bail.

5. Considering the above and the incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

6. Accordingly, the application for anticipatory bail is rejected.
