Course under Indira Gandhi National Open University. He failed in the examination held in the month of June, 2019 since he was given only two marks out of fifty marks in Abstract Algebra paper. The petitioner has filed this writ petition for re-evaluation his answer script of the said paper.

It is the grievance of the petitioner that no individual marks were awarded against the answers given by him. Only cross or tick mark was given by the examiner against the answers.

Mr. Som, learned advocate appearing for the University submits that the petitioner subsequently, again appeared in the examination held in the month of December, 2019 and secured pass marks to successfully complete the course.

At this juncture, if a direction is passed to re-

evaluate the answer script in question, the same will be an unnecessary exercise.

The University further suggests that it is permissible under the University Regulation for an examiner to indicate the marks given to a candidate against the answers only in the front sheet of the answer script. The relevant examiner has followed the said practice only.

I agree with the submission of the University. No effective purpose will be served by directing the University to re-evaluate the answer scripts at this juncture since the petitioner has already passed in the said paper and completed the course.

In that view of the matter, WPA 24334 of 2019 is disposed of without any order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
