08.11.2023 MNS/MB CRM (NDPS) 1813 of 2023 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure filed on 26.10.2023 in connection with Jalangi Police Station Case No. 339 of 2022 dated 02.11.2022 under Sections 20(b)(ii)(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In the matter of: Samsujjaman Mondal @ Samim .... Petitioner Ms. Antara Mukherjee ... for the petitioner Mr. Anowar Hossain, Ms. Sujata Das ... for the State.

1. Although, the petitioner submits that he is in custody for 371 days and a co-accused has been granted anticipatory bail, but we find that no recovery was made from the co-accused. The petitioner is the principal accused. The charges have been framed and the trial is fixed on 18th January, 2024.

2. We, therefore, are not inclined to enlarge the petitioner on bail at this stage.

3. We only direct the trial to be concluded as expeditiously as possible.

4. The application for bail, being CRM (NDPS) 1813 of 2023 is accordingly rejected.
