Learned advocate appearing for the petitioner submits that the subject-matter of the case relates to recovery of 3600 bottles of Phensedyl and petitioner is in custody for 1 year 4 months. It has been submitted that as there is no possibility of the trial commencing in near future, petitioner may be released on bail on any stringent condition. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the process against the absconding accused is in progress. However, the quantum of contraband seized being huge, release of the petitioner will jeopardize the trial of the case. In view of the quantum of seizure of contraband, I am of the view that the petitioner has failed to overcome the
rigors of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected.
However, the State is directed to take steps for splitting up of the trial, supply of copies and for consideration of charges.
Petitioner would be at liberty to renew his prayer for bail after the examination of seizure list witnesses is over. The application for bail, being CRM (NDPS) 1507 of 2025, is, thus, disposed of.
