The petitioners are aggrieved by the mode and manner in which the election process of the respondent no. 7 has been undertaken by the Election Commission. The major grievances are :- (a) presence of atleast 73 dead members in the electoral roll;

(b) the venue of election being fixed at a place far from the society's office;

(c) inclusion of certain villages in the schedule which are not within the domain of the respondent no. 6; (d) the manner in which the draft electoral roll and the final electoral roll were published and/or not published as alleged by the petitioners;

(e) the final electoral roll was allegedly published on 25.09.2025 while the draft electoral roll was handed over and/or accessed only on 30.10.2025.

With these and several other grievances the petitioners have approached this Court, several of which seem substantial. However, since the election process is underway, the petitioners are directed to file an appropriate application before the Election Commission by 28.11.2025 indicating all the afore-stated grievances along with particulars thereof. Such application will be moved upon notice to the Manager of the society, since there is no Board in place for the last twelve years. 3.

Mr. Srijan Nayak, learned counsel appearing for the Cooperative Election Commission submits that since these are all disputes relating to the electoral process, the Commission is empowered to look into the same and take a decision accordingly.

The respondent no. 2 is directed to take up the petition to be filed by the petitioners either by himself or through a duly appointed and authorized person on his behalf and after affording an opportunity of hearing to the petitioners, dispose of the same by 02.12.2025 upon notice to the petitioners. 5.

With these directions, the writ petition is disposed of. 6.

There shall be no order as to costs.
