Heard learned counsels for the parties.

Learned counsel for the petitioners takes this court to the written complaint lodged by the private opposite party and statement of witnesses recorded under Section 161 of the Code of Criminal Procedure. The attention of the court is drawn to the medical documents of the private opposite party. In course of the hearing, learned counsel for the petitioners submits that the petitioners seek to withdraw the application and craves leave for expeditious disposal of the trial before the learned trial court. The petitioners also seek to place all the issues taken in the revisional application before the learned trial court at the time of trial.

Such liberty is granted.

This court is informed that charges have been framed and witness action is yet to commence. Nine charge-sheeted witnesses are intended to be examined.

In view of the above, the learned trial court is directed to take the proceeding to its logical conclusion within one year from the next date of hearing fixed before him without granting any unnecessary adjournment to either of the parties, in accordance with law.

It is made clear that this court has not gone into the merits of the case and learned trial court shall be at liberty to deal with all the issues placed before him independently and in accordance with law.

CRR 4787 of 2024 is accordingly dismissed as withdrawn. As a consequence, CRAN 1 of 2025 stands disposed of. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon compliance of all necessary formalities. (Suvra Ghosh, J.)
