Asraf Ali, who retired as an Executive Assistant of the Sonachuri Gram Panchayat under the Nandigram I Development Block. Asraf died on August 19, 2014. The petitioner's mother also died on July 23, 2021.

It is submitted on behalf of the petitioner that after the demise of his mother, his claim for family pension, as a handicapped son, was forwarded to the Director of Pension, Provident Fund and Group Insurance, West Bengal, by the Block Development Officer, Nandigram I Development Block, by a letter dated December 12, 2023. However, no steps have been taken thereafter by the Director of Pension, Provident Fund and Group Insurance, West Bengal. I find no justification to keep the writ petition pending.

Accordingly, the writ petition is disposed of with a direction upon the Director of Pension, Provident Fund and Group Insurance, West Bengal, to consider

and decide the claim of the petitioner for family pension, pursuant to the communication dated December 12, 2023 issued by the Block Development Officer, Nandigram I Development Block, in accordance with law, within a period of three months from the date of communication of this order. Accordingly, WPA 26845 of 2025 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
