It is submitted by the learned counsel for the petitioner that during pendency of this revision the proceeding before the trial court has been dismissed for default on 07.08.2023. Considering the said order of the learned trial court, the present complaint case is not in existence as of date, though, it is fairly submitted by the learned counsel for the petitioners that an appeal against the said order of the Magistrate is pending before the learned Additional Session Judge.

Accordingly, at this stage, the present revision has become infructuous and accordingly disposed of.

Liberty is granted to the petitioner that in case the appellate court restores the matter, the petitioner will be at liberty to pray for appropriate relief before the appropriate forum including the issue in the present revision by way of fresh revision. ( Shampa Dutt (Paul), J. )
