Mr. Minhaz Serweny Islam Ms. Reshmi Khatun ...for the Petitioner This is an application wherein the petitioner has prayed for expeditious disposal of the S.L. case no. 585 of 2023, presently pending before the learned Additional Sessions Judge, 3rd Court, Berhampore, Murshidabad under Sections 325/326/427/307/303/34 of the Indian Penal Code. It is submitted on behalf of the petitioner that the FIR in this case was registered more than three years back on 7.10.2022 and thereafter, the charge-sheet was submitted and the trial started. However, out of 19 witnesses, only 2 witnesses have been examined so far and the petitioner is suffering for inordinate delay in disposal of the said proceeding and as such, she has prayed for a direction upon the court below for early disposal of the said proceeding.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed, the opposite parties will have no cause to prejudice and as such the service of copy of application upon the opposite parties is hereby dispensed with.

Having learned counsel for the petitioner, I find that the prayer made by the petitioner is justified and required to be allowed for the ends of justice.

In such view of the matter, CRR 5041 of 2025 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the abovementioned S.L. case no. 585 of 2023, and to make his best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
