Learned advocate appearing for the petitioner submits that there were recoveries of about 44 kgs of ganja from the joint possession of the petitioner and another. Charge-sheet has already been submitted, charges have been framed. As such there is no scope for the trial being completed, consequently, petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that commercial quantity of contraband has been seized and the petitioner is thickly connected with the offence. Prosecution in the charge-sheet has relied upon 23 witnesses.

As the petitioner has failed to overcome the rigors of Section 37 of the NDPS Act, I am of the opinion that the prayer for bail of the petitioner should be rejected. Accordingly, CRM (NDPS) 1511 of 2025 is rejected. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
