1. Parties are represented through their respective learned counsels.

2. With consent finally heard.

3. During the course of hearing, learned counsels for the parties reached to a consensus. It is agreed that the pending representation of petitioners dated 5.11.2025 may be directed to be decided by the learned District Magistrate, Purba Bardhaman within stipulated time.

4. Mr. Bandyopadhyay, learned senior standing counsel apprises the Court that pursuant to the

petitioners' representation the office of SubDivisional Land and Land Reforms Officer, Kalna, District-Purba Bardhaman by memo no.1150/1(1)SDL-Kalna/25 dated 25.11.2025 has already directed the petitioners to supply relevant documents and remains present before the said authority on 5.12.2025.

5. In view of consensus arrived at this PIL is disposed of with following directions.

i) Petitioners shall re-submit their representations dated 5.11.2025 (appearing at page 140) alongwith a copy of this order before the said District Magistrate, Purba Bardhaman.

ii) In turn, learned District Magistrate shall hear the petitioners, take relevant documents from petitioners and decide the said representation by a reasoned order expeditiously preferably within 180 days. It will be open to the District Magistrate to delegate his power to any other authority if the said authority is

competent to examine the facet of he matter.

It will also be open for the District Magistrate to hear the parties, who are going to be affected by his decision.

iii) If the petitioners are expecting any threat because of raising the present issue they may apprise the concerned police station by submitting a representation seeking protection. In that event, the concerned police station shall examine the same and do the needful (if required) in accordance with law.

6. With the aforesaid and without expressing any opinion on merits this PIL is disposed of.

7. Urgent Photostat certified copy of this order, if applied for, be delivered to the learned advocates for the parties, upon compliance of all formalities.
