Mr. Saswata Gopal Mukherjee, Ld. P.P., Mr. Neguive Ahmed,, Md. Anwar Hossain, Ms. Amita Gaur ... for the State Records reveal that one Manarul Islam Khan @ Manarul Khan and one Gaju Sk @ Soharab Hossain Mondal @ Md. Saharab Hossein preferred an application, being CRM 3976 of 2019 praying for anticipatory bail primarily on the ground that two similarly situated co-accused persons, namely, Motiur Rahaman @ Matiur Rahaman @ Motil and one Alauddin Molla @ Ala had been granted anticipatory bail. A co-ordinate Bench of this Court by an order dated 10th April, 2019 issued suo motu Rule calling upon the said co-accused persons to show cause as to why the order dated 20th March, 2019 in CRM 3323 of 2019 granting pre arrest bail to them should not be cancelled. The said Rule was registered as CRR 1195 of 2019.

Subsequently, on the prayer of the learned advocate appearing for the petitioners, the application for anticipatory bail

in CRM 3976 of 2019 was dismissed as not pressed by an order dated 22nd July, 2021. The co-ordinate Bench also passed orders in the present application calling for report from Director General and Inspector General of Police, West Bengal. Pursuant to such direction the report has already been filed by Mr. Mukherjee, learned Public Prosecutor appearing for the State.

Since the application for anticipatory bail, being CRM 3976 of 2019 has already been dismissed as not pressed, the Rule is discharged and CRR 1195 of 2019 is disposed of.
