Report submitted by the learned advocate appearing for the State be kept with the record. The petitioner complains over action and/or excesses inflicted upon him by a police officer in respect of a dispute arising out of an agreement. Learned advocate appearing for the petitioner submits that the terms of the agreement are yet to be completed. The petitioner has specifically named of a particular officer of Chinsurah Police Station regarding the excesses inflicted upon him and to that effect intends to rely upon some call details. However, the petitioner has not complained to any superior authority of the said police officer.

Learned advocate appearing for the State draws the attention of the Court to a case being registered pursuant to a complaint of one Nasima Khatun. The same is being Chinsurah Police Station Case No. 471/2024 dated 17.11.2024.

In case the petitioner has specific grievance against a particular police officer, he would be at liberty to approach the jurisdictional Magistrate by

invoking the provisions of 175(4) of BNSS, 2023. Learned Magistrate by adhering to the provisions of law would exercise his discretion.

With the aforesaid observations, the writ petition being WPA 27076 of 2024 is disposed of. There shall be no order as to costs.
