The report filed on behalf of the State is also taken on record.

Learned advocate appearing on behalf of the petitioners submits as follows. The petitioners organize shyma puja every year on the land in question. However, no formal permission had been given in this regard earlier. This year when the petitioners tried to apply for renewal of permission in the online portal, they could not do so because there was a requirement of filing a copy of the earlier permission. So they had no other option but to apply physically before the concerned Authority.

Learned advocate appearing on behalf of the State relies on the report and submits that the petitioners had not applied through the relevant portal.

It appears that the petitioners are unable to apply for organising the Kali Puja through the relevant portal because they are not in possession of any earlier permission. It is not denied that they had been holding the said puja for the last few years.

It is submitted that the petitioners have applied for permission to hold the said puja.

Let the concerned Sub Divisional Officer grant the relevant permission to the petitioners to organise the said puja at the said place, within 05.11.2023 provided the organizers conform to other usual norms.

With the aforesaid observations, the writ petition being WPA 25839 of 2023 is disposed of.

All concerned parties are to act in terms of a copy of this order downloaded from the official website of this court.
