Learned advocate appearing for the petitioner submits that the petitioner is in custody since January, 2018 and as such relying upon the earlier order dated 21.08.2024 passed in CRM(DB) 2190 of 2024, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that under the garb of cross-examination in respect of PW-8 at least four dates were sought for by the defence. State intends to tender nine more witnesses in support of its case. Having considered the stage of the case, I am not inclined to release the petitioner on bail at this stage. As such, the prayer for bail of the petitioner is rejected. Considering the period of detention of the present petitioner, learned Trial Court is directed to fix at least two
schedules in a month consisting of three dates and complete the examination of the prosecution witnesses by first week of April, 2026. No unnecessary adjournment be granted to any of the parties and trial of the case would continue in spite of any resolution of the local Bar.
Petitioner would be at liberty to approach this Court for renewal his prayer for bail in case the aforesaid time period is not adhered to by the prosecution.
Learned advocate for the State is directed to communicate this order to the learned Trial Court. The application for bail, being CRM (M) 2464 of 2025, is, thus, disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
