Matter relates to appointment of Teacher-incharge in Aurangabad High Madrasah (H.S.), District: Murshidabad. Petitioners are aggrieved by the steps taken by the respondents in appointing Teacher-incharge in the aforesaid Madrasah without following norms and in this regard some representations have been made to the concerned District Inspector of Schools (S.E.), Murshidabad for taking necessary steps. However, during the course of hearing learned advocate representing the respondent no.9 submits that said respondent no.9 has been granted approval as Teacher-in-charge in the aforesaid Madrasah vide Memo

dated 29th October, 2024. Copy of the approval Memo dated 29th October, 2024 is placed before this court and same is taken on record. A copy of approval Memo dated 29th October, 2024 is made over to the learned advocate representing the petitioners.

In view of approval granted by the concerned District Inspector of Schools (S.E.), Murshidabad the issue raised in this writ petitioner cannot be gone into unless approval Memo dated 29th October, 2024 is challenged.

At this stage, learned advocate representing the petitioners prays for leave to withdraw the writ petition with liberty to file afresh.

Having considered such submission the writ petition stands dismissed as withdrawn with liberty to take steps in accordance with law in view of approval Memo dated 29th October, 2024 issued by the District Inspector of Schools (S.E.), Murshidabad.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
