Petitioner is aggrieved by the fact that in spite of the learned Civil Judge granting temporary injunction in Title Suit No.353 of 2023, the private respondents have been violating the same, as such, creating mental torture upon the petitioner.

Learned advocate appearing for the State has submitted a report. Report reflects that at the relevant point of time in respect of the incident complained of police authorities have registered Haripal Police Station Case No.499 of 2023 dated 07.11.2023. Learned advocate for the State submits subsequently he has received instructions that the police have submitted charge-sheet in connection with the said case.

Learned advocate for the private respondent no.5 denies and disputes the contentions and

submitted that the petitioner is usurping jurisdiction of the police authorities for enjoying the property over which they have no right.

In view of the nature of the submissions made by the learned advocate appearing for the petitioner, State and the private respondent no.5, I am of the view that the petitioner and the private respondent no.5 are in a strained relationship. Accordingly, I direct the Officer-in-Charge, Haripal Police Station to ensure that there is no breach of peace and/or tranquility and a strict vigil be kept so that no untoward incident results.

With the aforesaid observations, WPA 25847 of 2023 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
