Petitioner approached this Court challenging the warrant of arrest which was issued in connection with CR Execution Case No.5 of 2020. In view of the non-payment, the execution case was filed.

Having considered the period of time which has elapsed, I direct that if the petitioner deposits 50% of the arrears by 19th October, 2023, the learned Judicial Magistrate in seisin of the matter would recall the warrant of arrest which has been issued and fix equally monthly instalments for realisation of rest of the amount. In case, during such period of regular payment of monthly instalments the learned Magistrate would be at liberty to stay the warrant of arrest for limited period till the amount is paid. With the aforesaid observations, CRR 4427 of 2022 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
