The petitioner approached this Court by filing this instant writ petition seeking direction upon the respondents, their agents, servants, subordinates, employees and/or assignees particularly the Controller of Examination, West Bengal University of Technology to allow the petitioner to appear in the 7th Semester of B. Tech Examination scheduled to be held on and from December 14, 2009 by issuing necessary Admit Card in his favour forthwith, without any hindrance from any authority.

None appears on behalf of either of the parties. No accommodation is sought for.

It is contention of the petitioner that he took admission in B.Tech course at Dumkol Institute of Engineering and Technology in the year 2007. He successfully completed 6th Semester and he was allowed to take admission in the 7th Semester upon payment of fees on August 14, 2009 and the examination of the 7th Semester would have started on and from December 14, 2009. He should be allowed to appear in the 7th Semester.

The petitioner was debarred to appear in the said examination of 7th Semester as there were backlogs in each of the 4th, 5th and 6th Semesters. Therefore, he is not at all eligible to appear in the 7th Semester examination.

At an earlier stage, a direction was passed that if the petitioner was otherwise eligible, he should be allowed to appear in the semester examination which he had backlog papers.

Considering the nature of prayer and long pendency of this case since 2009 particularly 16 years have elapsed, this Court seems either the purpose of the petitioner has already been served or he abandoned his prayer or the application has become infructuous due to passage of time.

In the above backdrop, WPA 21610 of 2009 is dismissed without any order as to costs.

Connected applications, if any, are also, thus, disposed of.

Interim order, if any, also stands vacated.

Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
