The petitioner in this application has made prayer for expeditious hearing of T.S. No.

347/2023 pending before the learned Civil Judge (Junior Division), 2nd Court, Sealdah.

Learned advocate for the petitioner submits that pursuant to the liberty granted by this court in WPA 20869/2023 (Subodh Kumar Gupta Vs.

The State of West Bengal and others) the petitioner instituted a suit against the respondent nos. 1 and 2. Learned advocate further submits that although there is urgency in the matter for which the petitioner filed an application for urgent repairs along with an application under order 39 rule 7 of the Code of Civil Procedure but the same are not disposed of by the learned trial judge.

It also appears from the records that when the matter appeared on 26.09.2023 the date was fixed on 6.10.2023. Learned advocate submits

that on 6.10.2023 also the matter was adjourned and the case is fixed on 21.11.2023.

Upon considering the prayer made by the petitioner, this court is of the view that no fruitful purpose will be served by issuing notice to the respondents.

This revisional application is disposed of with the direction that the application filed by the petitioner for repair along with the application under order 39 rule 7 of the Code of Civil Procedure be disposed of expeditiously upon giving opportunities to all the parties for hearing preferably within a period of four weeks after reopening after Puja Vacation.
