The petitioners are alleging encroachment on the Government land by the private respondents. Their representation to the said effect was pending before the authorities of the Public Works Department. They moved a writ petition being WPA 20592 of 2022 for a direction upon the authorities of the PWD to consider the said representation. The said writ petition was disposed of by directing the Executive Engineer, PWD to take a decision on the said representation.

The Executive Engineer by his order dated August 29, 2023 had informed the petitioners that the land on which encroachment has been alleged does not belong to PWD (Roads) but to

the Irrigation & Waterways Directorate, Bolpur, District- Birbhum.

The petitioners thereafter have given another representation to the Sub-Divisional Officer, Kandi, District -Murshidabad, the respondent no. 6 herein for removal of the said encroachment and demolition of the unauthorised structures on the said Government land.

The petitioners are praying that the said authority be directed to dispose of the said representation.

The respondent no. 6 is directed to consider and dispose of the said representation as expeditiously as possible in accordance with law after giving the petitioners and all concerned parties an opportunity of hearing.

W.P.A 25860 of 2023 is disposed of with the above terms without any order as to costs.
