CRR No. 4795 of 2024 In Re: Smt. Tapasi Das @ Tapashi Das Mr. Mriyutunjoy Chatterjee ... For the Petitioner Since the innocuous prayer of the petitioner is for expeditious disposal of C. R. Case no. 156 of 2016 pending before the learned Additional Chief Judicial Magistrate, Chandannagore, Hooghly the matter may be considered without service of notice upon the opposite party. The opposite party shall not be prejudiced by an order directing expeditious disposal of the case.
It appears from the record that evidence of complainant, examination of the accused under Section 313 of the Code of Criminal Procedure and examination of defence witnesses are complete. Several dates have been fixed for 'argument' in default judgment' by the learned Magistrate since 13th September, 2023. Learned Magistrate has not taken up the matter for hearing argument despite presence of both the parties before the learned Court on several dates. The matter is pending since 2016.
In view of the above, the learned trial Court is directed to dispose of the case within two months from the next date of hearing fixed before him without granting any unnecessary adjournment to either of the parties, in accordance with law.
CRR 4795 of 2024 is disposed of.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
