1. The petitioner has purchased a property from a borrower who has since expired. This property was mortgaged by the borrower in favour of the respondent no. 1 while taking a loan.
2. This purchase was by way of a private treaty and the Bank was not apprised of such sale. Since the property is under mortgage for an unpaid loan, registration thereof has not been considered.
3. Ms. Roy Choudhury, learned Advocate appearing for the Bank, submits that there is a substantial sum due and payable from the borrower, who has since expired, in respect of the said loan.
4. The petitioner submits that he will make a representation to the Bank giving a proposal for repayment of the loan and consequential registration of the property in his favour. Upon
receipt of such representation, if so advised, the Bank will deal with such representation in accordance with law.
5. With the aforestated direction, the writ petition is disposed of.
6. There shall, however, be no order as to costs.
7. Since no affidavit has been called for, the allegations contained in the writ petition are deemed to be denied.
8.Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
