This is an application for direction upon the trial Court for expeditious hearing of G.R. Case No. 7757 of 2014. On perusal of the averment made in the instant application this Court is of the view that the instant application can be disposed of with the assistance of the learned P.P.-in-charge. Mr. Ranabir Roy Chowdhury, learned advocate for the State is requested to assist this Court. Appointment of Mr.

Ranabir Roy Chowdhury be regularized by the learned Legal Remembrancer, Government of West Bengal.

The petitioner has filed the instant application praying for direction upon the trial Court for expeditious hearing of G.R. Case No.7757 of 2014.

It is submitted by the learned advocate for the petitioner that charge sheet has been submitted under Sections 341/323/34 of the Indian Penal Code in connection with the above mentioned case on 27th September, 2014. Thereafter, charge was framed against the petitioner on 14th July, 2015. In the charge sheet there are six witnesses. Amongst them only one witness has been examined in part.

I have duly considered the materials on record. It is necessary to note that a case under Sections 341/323 of the Indian Penal Code is pending for about nine years. The learned Judicial Magistrate, 3rd Court at Barrackpore is obviously not taking any serious step for early disposal of the case. It is submitted by the learned advocate for the petitioner that P.W.1 was examined partly and thereafter he was repeatedly summoned but he did not appear.

Under such circumstances the learned Judicial Magistrate, 3rd Court, Barrackpore is directed to dispose of the above mentioned case within three months from the communication of this order.

The revisional application is, thus, disposed of. (Bibek Chaudhuri, J.)
