Learned advocate appearing for the petitioner submits that the petitioner's elder sister retired as a Lecturer in Physiology from Raja Narendra Lal Khan Womens' College, Midnapore. She died on 2nd March, 2007. The mother of the petitioner died on 31st August, 2014. After the death of her sister, her mother was entitled to receive the family pension till her death but the same was not provided to her. Being the sole surviving daughter, the petitioner is entitled to said unpaid arrear pension to which her mother was entitled to from 31st August, 2014 to 2nd March, 2007. The petitioner approached different authorities for redressal of her grievance. Lastly, she made a representation through her lawyer before the Director of Public Instruction, West Bengal, by a letter dated March 12, 2021.

It is submitted that the said representation dated March 12, 2021 should have been considered by the Director of Public Instruction within a reasonable time.

The respondents are represented.

The factual aspects involved in this writ petition cannot be appreciated without exchange of affidavits. I direct the Director of Public Instruction, West Bengal to consider the representation dated March 12, 2021, as appearing at page 30 of the writ petition, within two months from the date of communication of this order. The Director of Public Instruction, West Bengal, shall hear the College and the petitioner before passing the order.

Such order should be communicated to the petitioner within a week thereafter.

Accordingly, WPA 26804 of 2022 is disposed of. There will be no order as to costs.
