Leave is granted to the learned advocate for the petitioner to correct the cause title.

Learned advocate appearing for the petitioner submits that allegedly from the house of the petitioner, 450 bottles of Phensedyl were recovered. Petitioner surrendered before the learned Trial Court on 11.07.2025. Petitioner is in custody for more than four months. Charge has already been framed by the learned Special Court on 30.08.2025. As such on behalf of the petitioner, on any stringent conditions, bail has been prayed.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that petitioner is a sole accused who has been absconding for a considerable period of time for which whole of the procedure has been delayed.

Be that as it may, petitioner has surrendered before the learned Trial Court and the prosecution documents reflect that 21 witnesses have been proposed to be examined by the prosecution. Having considered the period of detention of the petitioner, I am of the view that further detention of the petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Indadul Sk shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Special Court under the NDPS Act, 5th Court, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Murshidabad without the leave of the learned Special Court. The application for bail, being CRM (NDPS) 1513 of 2025, is, thus, disposed of.
