(DB) No. 3803 of 2024 In Re: - An application for bail under Section 439 of Code of Criminal Procedure / 483 of the B.N.S.S. 2023 in connection with Joyur P.S. Case No. 281 of 2023 dated November 30, 2023, under Sections 363/365/506/34 of the IPC and added Sections 364/302/201/120B of the IPC.

1. Dead body of the victim was recovered about three months from the date of the murder. Remains of the victim were recovered on the leading statement made by the petitioner before us. Petitioner called the victim allegedly to settle certain disputes since the victim instituted a criminal case prior to the present police case as against the petitioner.

2. Charges against the petitioner stands framed.

3. Petitioner is in custody for three hundred days.

4. Desirability of the petitioner to be enlarged on bail in the given facts and circumstances as narrated above does not appear to us.

5. In the facts and circumstances, we are not inclined to grant bail to the petitioner. The prayer for bail is rejected.

6. CRM (DB) No. 3803 of 2024 is rejected.
