Learned advocate for the petitioner, respondent nos. 1 to 7 as well as the learned advocate for the respondent nos. 8 to 11 is present.

I have considered the representation which was furnished to the Officer-in-Charge, Bizpur Police Station.

Prima facie, the background relates to a matrimonial discord.

The accusations are that the respondent no.

8 being the daughter-in-law along with rest of the respondents who are her relatives committed theft along with ransacking the house of the present petitioner and inspite of informing the police

authorities no action was taken. Number of GD Entries have been enclosed along with the representation.

There is a family dispute already existing.

Having considered the nature of the accusations made and that the police authorities have not registered a case, I grant liberty to the petitioner to approach the jurisdictional Magistrate under section 175(3) of the BNSS.

Learned Magistrate will assess the circumstances and pass necessary orders, if required under the provisions of law.

In the meantime, since the petitioner is a senior citizen, the police authorities would see that no breach of the peace takes place or any untoward incident crops up because of the present inimical relationship between the petitioner and the private respondents.

With the aforesaid observations WPA 27138 of 2024 is disposed of.
