The present appeal has been preferred by the West Bengal Central School Service Commission (hereinafter referred to as the Commission) and it's functionaries challenging the order dated 17th November, 2025 passed by the learned single Judge in the writ petition being WPA 25616 of 2025. By the said order, the learned single Judge has directed the Commission to take a decision as to whether the writ petitioner would be entitled to any mark(s) for prior teaching experience.

Bandopadhyay, learned senior advocate assisted by Mr. Bhattacharya, learned advocate

appearing for the appellants submits that the appointment of the writ petitioner does not have any approval of the State, the Commission or the Board. Mr. Dasgupta, learned advocate appearing for the writ petitioners/respondents herein submits that the order is an innocuous one and by the said order, the Commission had not suffered any prejudice.

The selection process has been initiated and would be conducted by the Commission in terms of the relevant rules and that as such the Commission is the competent authority to take a decision as to whether the writ petitioner would be entitled to any mark towards prior experience.

In the said conspectus, no interference is called for in the present appeal.

However, it is directed that at the time of hearing before the competent authority, the writ petitioner shall produce all necessary documents in support of their claim.

Mr. Bandopadhyay submits, upon instruction, that the Secretary of the Commission shall grant opportunity of hearing to the writ petitioner at his office on 10th December, 2025 at 11.00 a.m.

In view thereof, no further notice is required to be served upon the writ petitioner and she shall be present before the concerned officer, on the date and time specified, with all necessary documents.

With the above observations and directions, the appeal and the connected application are disposed of.

There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the learned advocates for the parties.
