Anisur Biswas And ANR. v. State Of West Bengal And ANR
23/12/2025 D/L - 24 Court No.28 S. Kundu Rejected C.R.M.(A) 4026 of 2025 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Nakashipara P.S case no. 728 of 2025 dated 13/7/2025 under Sections 85/115(2)/64/62/351(2)/3(5) of the BNS. In the matter of: Anisur Biswas & Anr.
...Petitioners.
Mr. Sumanta Das ...for the petitioners.
Mr. Aniket Mitra Mr. Prakash Mishra ...for the State.
1. Affidavit of service filed by the petitioners is taken on record.
2. Despite service no one appears on behalf of the de-facto complainant.
3. Heard the learned counsels for the parties.
4. Perused the case diary.
5. The prosecution case is that the as the husband of the victim was staying outside for work, the present petitioners who are the brothers-in-law tried to ravish the victim. The two children came, but were beaten up. Reliance is placed on the statement of the victim recorded before the Magistrate. The statements of the two minor children and the neighbours support the prosecution case. There is also an injury report indicating the marks of strangulation which is supportive of the statement of the victim recorded before the Magistrate.
6. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioners.
7. Accordingly, the application for anticipatory bail is rejected.
