Mr. Koustav Banerjee .... for the O.P. No. 2 Petitioner Mrinal Kanti Roy, Suvrajit Sen and Sucharita Roy is present personally in pursuant to the order of this Court. Their appearance is noted and dispensed with.

Nobody appears on behalf of the State.

Ms. Faria Hossain generally appears for the State is requested to appear in this case. Her appointment may be regularised by the concerned office of the learned Public Prosecutor, High Court, Calcutta. The petitioner has supplied copy of judgment passed on 4th February, 2021 by the learned Judicial Magistrate, 1st Court, Barasat is taken on record.

It appears from the judgment that the accused persons, namely, Suvrajit Sen, Mrinal Kanti Roy and Sucharita Roy found not guilty for the offences punishable under Sections 498A/406/34 of the Indian Penal Code,1860 and they have been acquitted from the case under

Section 248(1) of the Criminal Procedure Code and they have been discharged from the respective bail bonds in connection with GR Case No. 1424 of 2017 arising out of Baguihati P.S. Case No. 311/2017 dated 23rd April, 2017 under Sections 498A/406 of the Indian Penal Code , Under such circumstances the instant case become infructuous.

Accordingly CRR No. 3752 of 2017 is dismissed being infructuous. Accordingly, CRAN 1 of 2018 (Old No. CRAN 3057 of 2018 ) is disposed of.
