For the Respondent no. 5 On prayer of the petitioners liberty is granted to implead the Block Development Officer, Bhangor-I, South 24 Parganas as respondent no. 6 in the writ petition. The cause title of the writ petition be amended accordingly. Since learned counsel for the State shall also represent the added respondent, service of notice upon the added respondent is dispensed with.

The petitioners allege that despite approval of building plan in their favour by the Executive Officer, Bhangar - I Panchayat Samiti in 29th September, 2023, the Pradhan, Narayanpur Gram Panchayat has restrained them from raising such construction by a letter issued on 30th October, 2023. The petitioners have submitted a representation in this regard before the Block Development Officer on 6th November, 2023 which is yet to be considered. It appears from the letter issued by the Executive Officer, Bhangar I Panchayat Samiti in favour of the petitioners and two others on 29th September, 2023 that the

building plan for construction of two storied residential building was approved.

In view of the above, the Block Development Officer, Bhangor-I, being the 6th respondent herein, is directed to consider and dispose of the representation submitted by the petitioners dated 6th November, 2023 within two weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioners, in accordance with law. In disposing of the same, the concerned authority shall consider the building plan sanctioned in favour of the petitioners and take necessary steps at the earliest.

The writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
