08.12.2022 sdas rejected C.R.M. (DB) No. 4317 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Salanpur Police Station Case No. 170 of 2022 dated 29.07.2022 under Sections 363/365 of the Indian Penal Code and added Sections 302/201/34 of the Indian Penal Code.

And In Re : Padmabati Soren @ Tala Soren ..... petitioner Mr. Ayan Bhattacharjee Mr. Kunal Ganguly Mr. Somdev Ash ... for the petitioner Mr. Madhusudan Sur, learned APP Mr. Dipankar Paramanick ... for the State Learned Counsel appearing for the petitioner submits she is in custody for 132 days. It is also submitted that there is no direct evidence connecting her with the murder.

Investigation is complete. Petitioner prays for bail. Learned Counsel appearing for the State opposes the prayer for bail and submits petitioner is an active conspirator in the crime. She had made phone calls to the victim prior to the incident. Thereafter the victim was assaulted to death. On the joint disclosure statements of the petitioner and co-accuseds body of the victim and other articles were recovered.

We have considered the materials on record. Prior to the incident petitioner made phone calls to the victim. Thereafter victim was murdered. On the joint disclosure statements of the petitioner and co-accuseds dead body and other incriminating materials were recovered.

In view of the aforesaid incriminating materials, we are not inclined to grant bail to the petitioner. The application for bail is, thus, rejected. (Siddhartha Roy Chowdhury, J.) (Joymalya Bagchi, J.)
