Affidavit of service by the petitioner and the written instruction by the State respondents filed in Court today be retained with the records.

The petitioner got appointed in a Government Aided School where she joined on 16th September, 2016. Her appointment was approved by the District Inspector of Schools (Secondary Education), Purba Medinipur on 21st February, 2018.

Her allegation is that her arrear salary for the period 16th September, 2016 till 28th February, 2018 has not been paid.

Prayer has been made to direct the respondents to release the arrear salary of the petitioner.

Learned advocate representing the State respondents relies upon the instruction forwarded by

the District Inspector of Schools (Secondary Education), Purba Medinipur signed on 26th November, 2025 wherefrom it appears that the petitioner did not raise any claim for payment of her arrear salary.

The school authority submitted the arrear claim of the petitioner before the District Inspector of Schools on 28th November, 2024. Specific stand of the school is that as no prayer was made from the petitioner for releasing the arrear salary, accordingly, the prayer of the petitioner could not be forwarded to the District Inspector of Schools.

From the documents annexed to the writ petition, no document of the petitioner seeking arrear salary can be found.

In view of the above, the instant writ petition stands disposed of by directing the District Inspector of Schools (Secondary Education), Purba Medinipur to take necessary steps for releasing the arrear salary of the petitioner strictly in accordance with law after her claim is vetted by the Director of Accounts (SE), Purba Medinipur.

Steps shall be taken to disburse the arrear admissible salary at the earliest but positively within a period of twelve weeks from the date of communication of this order.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

11.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
