September 10, 2021 ARDR (44) WPA 28050 of 2017 Swapan Sarkar & ors.

Vs.

The State of West Bengal & Ors.

Mr. Chitta Ranjan Chakraborty, Mr. A. Rahaman, ...for the petitioners.

Mr. Susanta Pal, Md. A.R. J. Kabir, ...for the State.

Heard the learned counsels for the parties.

The petitioners complain that despite receiving Patta from the Government in respect of the land in question, the land was not mutated in their favour. The petitioners filed application before the respondent no.3 for such mutation on 3rd December, 2012, but the application has not been considered till date. Having heard the submissions made by the learned counsels appearing for the respondents and considering the material on record, I dispose of the writ petition with a direction upon the respondent no.3 to consider the application filed by the petitioners on 3rd December, 2012 within a period of three months from date of communication of this order after affording an opportunity of hearing to all the affected parties including the petitioners, in accordance with law.

Accordingly, WPA 28050 of 2017 is disposed of. However, there shall be no order as to costs. Since no affidavit has been invited, the allegations made in the writ petition are deemed to be not admitted.

Urgent certified website copy of this order, if applied for, be given to the parties upon compliance of all formalities.
