Learned advocate appearing for the petitioner prays for bail on the grounds that the medical report do not support the accusation against the petitioner and the petitioner is in custody for more than 6 months.

Learned advocate for the State has produced the case diary and drawn the attention of the Court to the statement of the victim under Section 183 of the BNSS.

I have taken into account the overall materials appearing in the case diary. However, I find that till date the

evidence of the victim has not been completed and only charge has been framed. The next date has been fixed on 7th January, 2026.

Learned Special Court would put in efforts so that the evidence of the victim is concluded at the earliest in compliance with Section 35 of the POCSO Act.

At this stage, the prayer for bail of the petitioner in CRM (M) 2583 of 2025 is dismissed.

Petitioner will renew his prayer for bail after the evidence of the victim girl is completed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
