11.03.2025 Sl. No.33 akd W. P. A. 27266 of 2024 [Sannyasi Pal -Vs- West Bengal State Electricity Distribution Company Limited & Ors.] Mr. Haradhan Mondal ... ... for the petitioner Mr. Sumit Ray ... ... for the WBSEDCL 1.

The petitioner has preferred the present writ petition alleging that respondent no.4 is operating a submersible pump illegally and frequently shifting the said motor to different locations, thereby causing grave inconvenience to the petitioner. 2.

It is pertinent to note that by an earlier order dated 21.05.2024 passed in WPA 28924 of 2023, this Court had directed the respondent- WBSEDCL to consider the petitioner's representation.

3.

Pursuant to the said order, learned Advocate for the petitioner states that he has received communication dated 28.08.2024 wherein the respondent-WBSEDCL had informed the petitioner that in compliance with the Court's directions dated 21.05.2024 passed in WPA 28924 of 2023, the necessary work had been completed from their end and the transformer had been installed on 18.06.2024 after the harvesting season. 4.

Perusal of the said speaking order dated 28.08.2024 reveals that the said order was passed in compliance of the order dated 21.05.2024 passed in WPA 28924 of 2023 and the grievance of the petitioner qua the non-grant of electricity

connection with respect to the submersible pump has already been addressed.

5.

Further, the present writ petition appears to be misconceived as it primarily challenges the connection granted to a third party namely Tamal Krishna Pal.

6.

Learned Advocate for WBSEDCL has categorically stated that the electricity connection granted to the respondent no. 4 is in accordance with law and the submersible pump in question is being operated in accordance with law. Learned Advocate for the Respondent further emphasis that no illegality has been committed while granting electricity connection to the Respondent no. 4.

7.

This is not a public interest litigation. Since the grievance of the Petitioner qua non grant of electricity connection is already redressed, nothing survives in the present writ petition. 8.

Accordingly, the writ petition is dismissed.

9.

There shall be no order as to costs.

10.

Let urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking. (Gaurang Kanth, J.)
