Learned advocate for the petitioners is present. None appears on behalf of the opposite parties. I have perused the contentions advanced in this revisional application, the foundation of which is based on mixed question of fact and law and are to be adjudicated in course of trial of the case. Having regard to the same, I grant liberty to the petitioners to canvass all the points agitated in this revisional application at the appropriate stage of trial of the case before the learned Judicial Magistrate, 3rd Court, Asansol.

With the aforesaid observations, the revisional application being CRR 4425 of 2009 is disposed of. Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
