And In Re : Rishabh Gupta ..... petitioner Mr. Souvik Mitter Mr. Tapas Maity .....for the petitioner Mr. Sachit Talukdar ..... for the State Mr. Sandip Chakraborty ..... for de facto complainant 1.
Learned Counsel for the petitioner submits there was free fight between two groups and he has been falsely implicated.
2.
Learned Counsel for the State opposes the prayer for anticipatory bail.
3.
Learned Counsel for the de facto complainant submits he had protested against illegal use of headlight. As a result he was mercilessly beaten by the petitioner and his associates. He suffered eye injury.
4.
We have considered the materials on record. Victim had objected to the illegal use of headlight. As a result he was mercilessly assaulted by the petitioner and his associates. He
suffered severe eye injury which was life threatening. In view of the daring conduct of the petitioner and his associates who appear to have scant regard for rule of law, we are not inclined to grant anticipatory bail to the petitioner.
5. Accordingly, prayer for anticipatory bail is rejected. (Gaurang Kanth, J.) (Joymalya Bagchi, J.)
