Mukherjee Ms. Susmita Chatterjee ..for KMC This writ petition has been filed alleging unauthorized construction at the behest of respondent Nos. 9 to 14. It appears that, during the pendency of this writ petition, a demolition order was issued by the Corporation, although the petitioner claims to be unaware of such an order.

In contrast, respondent No. 11 asserts that, in response to the demolition order, he has filed B.T. Appeal No. 12 of 2024 before the Municipal Building Tribunal.

In light of these developments, there is no justification to keep this writ petition pending. Therefore, this writ petition is disposed of with a direction to the Tribunal to expedite the hearing of the appeal. The petitioner is granted liberty to file an application seeking appropriate relief before the Tribunal. Accordingly, WPA 25942 of 2023 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
