22/12/2025 D/L - 60 Court No.28 S. Kundu Allowed C.R.M.(A) 4047 of 2025 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Ghatal P.S case no. 143 of 2025 dated 29/4/2025 under sections 85/80(2)/103(1)/3(5) of the BNS.

In the matter of: Jyostna Bairi @ Jamuna Bairi @ Jyotsna Bairi & Anr.

...Petitioners.

Mr. Tanmoy Chowdhury Ms. S. Sarkar ...for the petitioners.

Mr. Bidyut Roy Mr. Karan Bapuli ...for the State.

1. Learned counsel appearing for the petitioners submits as follows. The petitioners are the mother-in-law and the sister-in-law of the alleged victim. The marriage took place five years ago. The principal accused was arrested and was thereafter granted bail. Charge-sheet has been submitted.

2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He submits that the pregnant lady was assaulted, tortured by the husband and other accused and was ultimately put to death. She died due to hanging. He refers to the statements of the father of the victim and the minor child of the victim, as also the post-mortem report.

3. The child of the victim has alleged that it was the father who had killed her mother and made her hang from a fan. Even according to the statements of neighbours, the main allegations are against the husband.

4. Considering the above, the other materials available in the case diary, the fact that the principal accused was arrested and was thereafter granted bail, the alleged role ascribed to the present petitioners and the fact that charge-sheet has been submitted, I am inclined to grant anticipatory bail to the petitioners.

5. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall not threaten or intimidate the witnesses. The petitioners shall surrender before the learned jurisdictional Court and pray for bail within four weeks from date and shall attend the jurisdictional Court regularly.

6. Accordingly, the application for anticipatory bail is allowed.

7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
