The petitioner claims to be the owner of several plots of land within Mouza-Deriachak under Khatian No.3431 under Police Station-Kolaghat in the District of Purba Medinipur.
The petitioner alleges that the private respondents are carrying on pisciculture by illegally converting agriculture land into artificial fishery pond adjacent to the lands of the petitioner. Petitioner claims to have made several representations before the respondent authorities. Mr. Bhattacharya, learned advocate appearing for the petitioner submits that no steps have been taken by the respondent authorities till date.
Mr. Mahata, learned Additional Government Pleader submits that in the representation dated March 17, 2017
no particulars of the plots which are alleged to have been converted to artificial ponds were mentioned for which the respondent authorities could not take any steps. In reply, Mr.
Bhattacharya submits that subsequently another representation has been submitted. Mr. Mahata submits that in the representation dated November 10, 2025 only the plot numbers of the petitioner have been mentioned but the adjoining plot numbers which is alleged to have been converted into an artificial pond has not been mentioned.
The private respondents are represented by its learned advocate.
He submits that the private respondents are lessees in respect of certain plots of land which has been leased out in their favour for the purpose of carrying out pisciculture activities.
Since the representation dated November 10, 2025 did not mention the particulars of the plot(s) which is/are alleged to have been converted into artificial pond, no relief can be granted to the petitioner in this writ petition. WPA 26931 of 2025 stands disposed of by giving liberty to the petitioner to submit a comprehensive representation before the Additional District Magistrate and District Land and Land Reforms Officer, Purba Medinipur at Tamluk, being the respondent No.4 mentioning the specific plot numbers which, according to the petitioner, has been illegally converted to an artificial pond, the classification of which is agricultural land.
If such a representation is submitted, the authorities shall consider and dispose of the same in accordance with law as expeditiously as possible.
There will be no order as to costs.
