10-02-2025 (ct. no. 29) KOLE CRAN 2 of 2025 in CRM (DB) 4331 of 2022 In re: An application for relaxation of condition of bail under Section 439(1)(b) of the Code of Criminal Procedure/Section 483(1)(b) of the BNSS - A n d - In the matter of : Laltu Ghosh .... Petitioner.

Mr. Prabir Majumder, Mr. Debraj Shil, ... for the petitioner.

Ms. Baishakhi Chatterjee, .... For the State.

IN Re: CRAN 2 of 2025 1.

The petitioner was granted bail by an order dated December 8, 2022 passed in CRM (DB) 4331 of 2022, inter alia, on the condition that he shall not enter the district of Nadia except for the purpose of attending court proceeding and/or investigation and he shall report to the officer in charge of the concerned Police Station within whose jurisdiction he shall reside once in a week until further orders.

2.

In July 2023, the petitioner applied for relaxation of the aforesaid two conditions of bail by filing CRAN 1 of 2023. By an order dated July 20, 2023, a Coordinate Bench waived the aforesaid two conditions but directed the petitioner to report to the Officer-inCharge of Nabadwip Police Station once in a month until further orders.

3.

The petitioner has now applied before us for waiver of that condition. He says that he has been scrupulously complying with

the said condition since July, 2023. It is causing great inconvenience to him.

4.

The State files a report wherefrom it appears that the petitioner has been reporting to the Officer-in-Charge of Nabadwip Police Station once in a month. It, therefore, appears that the petitioner is adhering to the bail conditions. There is little possibility of an early conclusion of the trial. Hence, we are inclined to waive the condition requiring the petitioner to report to the Officer-inCharge of the Nabadwip Police Station once in a month and we do so. However, if and when the petitioner is called for by any police authority, the petitioner shall promptly respond. He must also adhere to the other bail conditions, including that he shall appear before the learned Trial Court on every date of hearing until further orders.

5.

CRAN 2 of 2025 is, thus, disposed of.

6.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. ( Apurba Sinha Ray, J. ) ( Arijit Banerjee, J. )
