By consent of the parties, the revisional application is taken up for consideration along with the application being CRAN 1 of 2025.

Heard learned counsels for the parties.

The petitioner has assailed the order dated 22nd May, 2024 passed by the learned Judge, Special Court (POCSO Act) Barasat, North 24 Parganas in Special Case No.104 of 2023 directing issuance of proclamation and attachment simultaneously without assigning any reason therefor in compliance with Section 83(1) of the Code of Criminal Procedure.

Since the order impugned is in violation of Section 83(1) of the Code of Criminal Procedure, the order requires to be quashed/set aside.

Accordingly, the revisional application is allowed.

The order dated 22nd May, 2024 passed by the learned Judge, Special Court (POCSO Act) Barasat, North 24 Parganas in Special Case No.104 of 2023 be quashed/set aside.

The application being CRAN 1 of 2025 is disposed of. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
