Affidavit-of-service filed by the petitioners be kept with the record.

Petitioners approached this Court being aggrieved with the progress of the investigation of Kalyani P.S. Case No.410 of 2017 dated 02.11.2017. The case was registered under Sections 406/420 of the Indian Penal Code against one Koushik Dutta. In course of investigation, the said Koushik Dutta was arrested on 12.12.2017. The statement under Section 164 of the Code of Criminal Procedure of the writ petitioners were recorded and on conclusion of investigation charge-sheet was submitted on or about January, 2020 against the said Koushik Dutta.

Report further reflects that after charge-sheet was submitted, the accused was absconding.

Consequently, warrant of arrest has been issued. Report also reflects that the next date is fixed on 05.05.2026.

Having considered that the accused is absconding and fleeing away from the process of law, I direct that the Additional S.P/SDPO in-Charge of Kalyani Police Station, Ranaghat Police District will monitor regarding the execution of the warrant of arrest. The accused be further brought before the court. In case the accused is produced, learned Magistrate is directed to impose stringent condition so that each and every date the accused is present before the court so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, WPA 26194 of 2018 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioners. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
